Rubbish Removal Docklands Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Docklands provides rubbish removal, waste collection and related services to domestic and commercial customers in the United Kingdom. By booking or using our services you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order.

1. Definitions

In these Terms and Conditions, the following words have the meanings given:

Customer means the person, company or organisation requesting or receiving the services.

Services means any rubbish removal, waste collection, loading, transportation, clearance, recycling, disposal or related services that we provide.

Waste means any items, materials or substances that the Customer asks us to remove as part of the Services, including household, commercial or garden waste, subject to the restrictions in these Terms and Conditions.

Contract means the agreement between us and the Customer for the supply of Services as set out in these Terms and Conditions and any written confirmation of booking.

We, us, our means Rubbish Removal Docklands.

2. Scope of Services

We provide rubbish removal and waste collection services within designated service areas, which may change from time to time. Our Services generally include loading the Waste onto our vehicle, transporting it from the collection address and arranging lawful treatment, recycling or disposal.

We reserve the right to refuse to collect certain types of Waste, including but not limited to hazardous, toxic, clinical, medical, chemical, pressurised or explosive materials, asbestos, gas bottles, certain electrical items or any material that we reasonably consider unsafe, illegal or unsuitable for our Services or facilities. If the Customer presents such Waste for collection, we may refuse collection in whole or in part, charge an additional fee or cancel the Service.

3. Booking Process

3.1 Bookings may be made by telephone, email or other communication channels we make available. A booking request is an offer by the Customer to purchase Services in accordance with these Terms and Conditions.

3.2 We will confirm acceptance of a booking by providing written or verbal confirmation, which will include the proposed service date, collection window, indicative pricing and any special conditions. The Contract is formed when we confirm acceptance of the booking.

3.3 All bookings are subject to availability of vehicles, staff and disposal facilities. We may refuse or cancel a booking at our discretion, for example where the Customer has previously failed to pay, breached these Terms and Conditions, or where we reasonably believe that the Service cannot be safely or lawfully provided.

3.4 The Customer is responsible for providing accurate information at the time of booking, including the type and approximate quantity of Waste, access conditions, parking restrictions and any factors that may affect the time, cost or feasibility of the Service.

4. Access, Parking and Customer Responsibilities

4.1 The Customer must ensure that our team has safe, timely and reasonable access to the property and to the Waste at the agreed time. This includes providing accurate entry instructions, ensuring that someone is present if required, and securing any necessary permissions for access.

4.2 The Customer is responsible for arranging and paying for any parking permits, visitor passes or congestion and access permissions required to allow our vehicle to park near the collection point. Any parking charges, fines or penalties reasonably incurred in delivering the Services as a direct result of inaccurate information or omissions by the Customer may be charged to the Customer.

4.3 The Customer must ensure that the collection area is safe, free from unreasonable hazards, and that the Waste is accessible. We may refuse to move or collect items where doing so would pose a risk to health and safety, cause damage to property or breach any law or regulation.

4.4 The Customer warrants that they are the owner of the Waste or have the authority of the owner to arrange its removal. The Customer is responsible for ensuring that the Waste presented for collection is suitable for removal under these Terms and Conditions.

5. Pricing and Quotations

5.1 Prices for our Services may be quoted as a fixed price, by volume of Waste, by weight, by time spent on site, or by a combination of these methods. We will explain the pricing basis at the time of booking.

5.2 Any quotation given before we attend the property is an estimate only and is based on the information provided by the Customer. The final price will be confirmed on site once our team has inspected the Waste, verified access conditions and assessed any additional work or time required.

5.3 If the quantity or type of Waste, or the access conditions, differ materially from those described at the time of booking, we may adjust the price accordingly. The Customer has the right to accept the revised price or decline the Service. If the Customer declines after we have already attended the property, a call-out or cancellation charge may apply.

5.4 All prices are stated in pounds sterling and, unless expressly stated otherwise, are inclusive of standard disposal charges, labour and applicable taxes. Additional charges may apply for difficult access, extra labour, heavy items, waiting time, or for certain types of Waste that incur higher disposal costs.

6. Payments

6.1 Payment is due in full on completion of the Service, unless we agree alternative payment terms in writing before the work begins.

6.2 We accept payment by cash, debit card, credit card or other payment methods we may make available from time to time. For commercial Customers, invoice terms may be offered at our discretion, subject to credit checks and agreed payment terms.

6.3 If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate, charge reasonable debt recovery costs and suspend or cancel any further Services until all outstanding amounts have been settled.

6.4 The Customer is responsible for all sums due under the Contract. Where a third party has agreed to pay, the Customer remains liable if the third party fails to do so.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting us during our normal business hours. We request as much notice as possible so that we can allocate resources efficiently.

7.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged. We reserve the right to apply a reasonable administrative charge for repeated cancellations.

7.3 If the Customer cancels a booking within 24 hours of the scheduled collection window, or fails to provide access when our team attends the property, we may charge a cancellation or call-out fee to cover our costs, including staff time and transport.

7.4 We may cancel or reschedule a booking where we are unable to provide the Service due to circumstances beyond our reasonable control, including vehicle breakdown, staff illness, severe weather, access issues, or restrictions at disposal facilities. In such cases, we will endeavour to offer an alternative date and time, but we will not be liable for any indirect losses arising from such cancellation or delay.

8. Service Delivery and Timeframes

8.1 We will use reasonable efforts to attend the property within the agreed time window. Any timeframes given are estimates only and are not guaranteed, as they may be affected by traffic, access conditions, previous jobs and other factors beyond our reasonable control.

8.2 If we expect significant delay, we will attempt to notify the Customer as soon as reasonably possible and agree a revised arrival time or alternative date.

8.3 Our team will act with reasonable care and skill in the performance of the Services. The Customer must check that all items intended for removal have been taken before our team leaves the property, as subsequent visits may incur additional charges.

9. Waste Handling and Regulations

9.1 We operate in accordance with applicable UK waste management legislation and guidance. This includes, where required, holding appropriate registrations and using licensed facilities for the treatment, recycling and disposal of Waste.

9.2 We will take responsibility for the Waste once it has been loaded onto our vehicle, subject to third party facilities being available and lawful. Until that point, the Waste remains the responsibility of the Customer.

9.3 We may segregate, sort or process Waste to maximise reuse, recycling and recovery in line with good practice and regulatory requirements. The Customer agrees that title to the Waste transfers to us upon collection, except where otherwise required by law.

9.4 The Customer must not present for collection any Waste that is prohibited under these Terms and Conditions or under relevant waste regulations. If prohibited Waste is discovered after loading, we may return it to the Customer or charge additional costs for safe handling, storage and lawful disposal.

10. Liability and Damage

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

10.2 Subject to the above, our total liability to the Customer arising out of or in connection with the Contract, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable for the specific Service giving rise to the claim.

10.3 We will take reasonable care to avoid damage when removing Waste. However, the Customer acknowledges that minor scuffs or marks may occur when moving bulky or heavy items through narrow or restricted spaces. We are not liable for such minor cosmetic damage that could not reasonably be avoided.

10.4 We are not liable for any loss or damage arising from inaccurate information provided by the Customer, poor condition of the property or fixtures, hidden defects, or items left inside furniture, bags or containers that the Customer has asked us to remove.

10.5 We will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of data, arising out of or in connection with the Services or the Contract.

11. Customer Property and Items Not Intended for Removal

11.1 The Customer must clearly identify any items that are not to be removed and must keep them separate from the Waste wherever reasonably possible.

11.2 We accept no responsibility for the removal of items mistakenly presented as Waste by the Customer or left in areas designated for clearance. The Customer should check all drawers, cupboards, bags and containers before our team begins work.

11.3 If we are notified promptly and where feasible, we will use reasonable efforts to recover any item removed in error, but we are under no obligation to do so and may not be able to retrieve items once they have entered the waste stream.

12. Insurance

12.1 We maintain appropriate insurance cover in line with our operations, including public liability insurance at levels we consider suitable for our Services.

12.2 Details of our insurance arrangements are available on request. Our insurance does not replace the need for the Customer to maintain their own buildings, contents or business interruption insurance as appropriate.

13. Data Protection and Privacy

13.1 We collect and process Customer information only to the extent necessary to manage bookings, deliver Services, handle payments and, where applicable, meet our legal obligations.

13.2 We will take reasonable steps to keep personal information secure and to use it in a lawful, fair and transparent manner in accordance with applicable data protection legislation in the United Kingdom.

14. Complaints and Dispute Resolution

14.1 If the Customer is dissatisfied with any aspect of the Service, they should contact us as soon as possible, providing details of the issue and any supporting information.

14.2 We will investigate complaints in a fair and timely manner and will endeavour to propose a reasonable solution where appropriate. Any claim relating to damage or loss should be notified to us within a reasonable time of the Service being provided.

15. Changes to These Terms and Conditions

15.1 We may amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our operations.

15.2 The version of the Terms and Conditions in force at the time of booking will apply to that Contract. Updated versions may be applied to future bookings.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, save that if you are a consumer resident in another part of the United Kingdom you may also bring proceedings in your local courts.

17. General Provisions

17.1 If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or competent authority, the remaining provisions shall remain in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 The Contract is between us and the Customer. No other person shall have any rights to enforce any of its terms.

17.4 These Terms and Conditions constitute the entire agreement between us and the Customer in relation to the Services and supersede any prior discussions, correspondence or understandings.
